Society Ignoring Structural Crack Complaint in Flat
What you need to know
Visible structural cracks on the exterior wall of a top-floor flat are a serious safety hazard and the housing society has a legal duty to maintain the building's structural integrity under the Maharashtra Co-operative Societies Act (or the applicable state Co-operative Societies Act). Ignoring a written complaint about a life-threatening structural defect amounts to negligence and dereliction of duty by the Managing Committee. If the society fails to act, you can escalate to the Registrar of Co-operative Societies and the local municipal authority (BMC/municipal corporation), who have power to issue structural safety notices and even order evacuation. You can reasonably expect a formal inspection, repair order, or legal direction to the society within weeks of filing official complaints.

Complain to the Registrar of Co-operative Societies

- Request that the Registrar issue a direction under Section 79A to the society to carry out urgent structural repairs
Escalate to Municipal Authority and Co-operative Court if no action

- If society still refuses, file a dispute before the Co-operative Court under Section 91/146 seeking mandatory repair order and compensation
