How to Register a Court Marriage in India
What you need to know
Court marriage in India refers to solemnizing and registering a marriage under the Special Marriage Act, 1954, which applies to all citizens regardless of religion, caste, or nationality. It is a fully legal and recognized form of marriage that does not require religious ceremonies. Both partners must give a 30-day advance notice to the Marriage Registrar, after which the marriage is solemnized in the Registrar's office in front of three witnesses. Once registered, the Marriage Certificate is a legally valid document accepted by all government authorities, courts, banks, and foreign embassies.

What you should do now

- Both parties must be adults (groom 21+, bride 18+), mentally sound, and not within prohibited degrees of relationship
- Collect: age proof (birth certificate/10th marksheet), address proof, passport-size photos, and ID proof (Aadhaar/passport) for both parties and three witnesses
Submit Notice of Intended Marriage to the Marriage Registrar
- Visit the office of the Marriage Officer (Sub-Divisional Magistrate or designated Registrar) of the district where at least one party has lived for 30+ days
- Fill Form 1 (Notice of Intended Marriage) and pay the prescribed fee; the notice will be displayed publicly for 30 days
- If anyone files an objection, the Registrar will investigate; baseless objections can be challenged legally
Appear for solemnization after the 30-day notice period
- Both parties and three witnesses must be present at the Registrar's office on the appointed date
- Sign the declaration in front of the Marriage Officer; the marriage is then solemnized and recorded in the Marriage Register
Obtain and use the Marriage Certificate
- Collect the official Marriage Certificate (Form 6) the same day or as per office schedule
- Use the certificate to update name/marital status in Aadhaar, passport, bank accounts, and for visa applications
