Understanding IPC Section 302 – Murder Charge in India

IPC Section 302 (now BNS Section 103) deals with the punishment for murder under Indian law. A person convicted of murder can face the death penalty or life imprisonment, along with a fine. Bail is generally not available for a Section 302 charge as it is a non-bailable, cognizable offence triable exclusively by a Sessions Court.

Understand the FIR and charges
- Obtain a copy of the FIR filed at the police station under Section 173 CrPC
- Review whether the charge is murder (S.302) or culpable homicide not amounting to murder (S.304) — distinction is critical for sentencing
Apply for bail or anticipatory bail if applicable
- File a bail application before the Sessions Court (S.439 CrPC) — police cannot grant bail for S.302
- If the Sessions Court rejects bail, approach the High Court; ultimately the Supreme Court under Article 136
Prepare for Sessions Court trial
